These Terms of Service ("TOS") constitute a legally binding agreement between you ("User," "you," or "your") and Extremesoft Bilisim Reklamcilik Ticaret Limited Sirketi ("Extremesoft," "Company," "we," "us," or "our"), governing your access to and use of our mobile applications, games, websites, and related services (collectively, the "Services").
BY ACCESSING OR USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TOS. IF YOU DO NOT AGREE TO THESE TOS, DO NOT ACCESS OR USE OUR SERVICES.
By accessing the Services in any manner, including, but not limited to, visiting or browsing our website, downloading our applications, or accessing any of our games, you agree to be bound by these TOS. These TOS apply to all users without limitation. You may only access the Services if you agree to abide by all applicable laws and these TOS. If you access or attempt to access the Services from a country where any of the Services are banned, you do so at your own risk and will be responsible for compliance with local laws.
You must be at least 13 years of age to use our Services. If you are under 18 years of age (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these TOS on your behalf. By using our Services, you represent and warrant that you have the legal capacity to enter into this agreement.
Some Services may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Extremesoft immediately of any unauthorized use of your account. Extremesoft shall not be liable for any loss or damage arising from your failure to protect your account information. You agree that you shall not share your account with any other person under any circumstance and that you are solely responsible for all activities conducted through your account.
Our Services may include virtual currencies, virtual items, or other digital content ("Virtual Goods"). Virtual Goods may be purchased with real currency if you are a legal adult or with the involvement of your parent or guardian. You acknowledge that:
(a) Virtual Goods have no real-world monetary value and cannot be redeemed, refunded, transferred, or exchanged for real currency or any item of value outside the Services;
(b) You do not own Virtual Goods but are granted a limited, personal, non-transferable, non-sublicensable, revocable license to use them within the Services;
(c) Extremesoft may modify, manage, regulate, control, or eliminate Virtual Goods at any time, with or without notice, without any liability to you;
(d) All purchases of Virtual Goods are final and non-refundable, except as required by applicable law;
(e) The sale, gift, barter, trade, or transfer of Virtual Goods outside of our Services is strictly prohibited and may result in immediate account termination without refund;
(f) Extremesoft does not recognize any purported transfers of Virtual Goods effectuated outside of the Services, or the purported sale, gift, or trade of anything that may appear on third-party websites.
All payments for Virtual Goods or premium features are processed through third-party platforms including but not limited to Apple App Store and Google Play Store. By making a purchase, you agree to the payment terms and conditions of the applicable third-party platform. Extremesoft is not responsible for any issues arising from transactions processed by third-party payment providers. All fees are non-refundable unless otherwise required by applicable law or the policies of the third-party platform.
Extremesoft reserves the right at its sole discretion to review, monitor, prohibit, edit, delete, disable access to, or otherwise make unavailable any content made available by users of the Services without notice for any reason or for no reason at any time. If at any time Extremesoft chooses, at its sole discretion, to monitor the Services, Extremesoft nonetheless takes no responsibility for content made available by users of the Services, and Extremesoft accepts no obligation to modify or remove any inappropriate content.
You assume all risks associated with dealing with other users with whom you come into contact through the Services. If you have a dispute with other users, you release Extremesoft from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
By using our Services, you agree to abide by the following rules of conduct. Violation of any of these rules may result in immediate suspension or termination of your account without refund or compensation.
(1) Exploits and Cheating: You will not use exploits or illegal or unauthorized means to interfere with or adversely impact any other user's ability to use the Services as intended; to gain unfair gameplay advantage; or to gain access to Virtual Goods or other content to which you do not have valid entitlement. This includes the use of cheats or so-called "mod menus", unauthorized mods, hacks, glitches, or any other technical exploits, and phishing, scamming, or social engineering.
(2) Privacy Violations: You will not use the Services to create, upload, or distribute any User Content that violates or invades another person's privacy. This includes "doxing" i.e. sharing or threatening to share information to embarrass, intimidate, harm, or harass another person.
(3) Fraud and Spam: You will not use the Services to engage in fraud, or to create, upload, or distribute any User Content that is knowingly or intentionally misleading, false, or fraudulent. You will not use the Services to engage in "spam," i.e. repeatedly or periodically misuse a communication channel in a way that disrupts or interferes with the operations of the Services, advertises any third-party product or service, or adversely impacts any other user's ability to use the Services as intended.
(4) Violent and Graphic Content: You will not use the Services to create, upload, or distribute User Content that contains actual or shockingly realistic depictions or descriptions of gore, excessive violence, torture, or animal cruelty. This includes all depictions of such content, regardless of whether the User Content is real or manipulated media, animation, computer-generated imagery, or other digital creation.
(5) Self-Harm and Dangerous Activities: You will not use the Services to create, upload, or distribute User Content or engage in conduct that depicts, promotes, or attempts to normalize, encourage, or knowingly result in another person's eating disorder, suicide, or other acts of physical self-harm or endangerment. This includes User Content or conduct that is reasonably understood to facilitate, encourage, or instruct another person to physically harm or starve themselves; to consume dangerous amounts of alcohol, drugs, or other substances; or to engage in any dangerous real-world "stunt," "challenge," or unsanctioned activity that is likely to result in serious injury to themselves or others.
(6) Harassment and Bullying: You will not use the Services to create, upload, or distribute User Content or engage in conduct that is abusive, bullying, harassing, or is reasonably understood to be a physical or verbal threat against another person. This includes User Content that is defamatory and conduct such as camping, griefing, stream sniping, swatting, or other abusive in-game behavior.
(7) Sexual Content and Harassment: You will not use the Services to create, upload, or distribute any User Content or engage in conduct that is pornographic, obscene, or sexually harassing. This includes distributing unsolicited or unwanted sexually suggestive User Content; engaging in unsolicited or unwanted sexualization of another person; making threats or attacks based on another person's actual, perceived, or supposed sexuality or sexual activity; or the unauthorized sharing of another's intimate or sexually explicit content without their consent.
(8) Child Safety: You will not use the Services to create, upload, or distribute any User Content or engage in conduct that depicts, promotes, or attempts to normalize, encourage, or knowingly result in the sexual abuse of minors. This includes User Content that in any way sexualizes minors, including real or manipulated media, animation, computer-generated imagery, or other digital creation; engaging or attempting to engage in sexually suggestive or explicit communication with a minor; and soliciting sexually suggestive or explicit content from, or sharing sexually suggestive or explicit User Content with, a minor.
(9) Hate Speech and Discrimination: You will not use the Services to create, upload, or distribute User Content or engage in conduct that constitutes hate speech or behavior, which we define to be any form of expression that is reasonably understood to attack or promote hatred or violence against an individual or group based on any of the following characteristics: age; color or race; disability; ethnicity; gender or gender identity; national origin or immigration status; religious affiliation; sex or sexual orientation; military service; socioeconomic class, status, or caste; or weight, size, or body type.
(10) Terrorism and Violent Extremism: You will not use the Services to create, upload, or distribute User Content or engage in conduct that depicts, promotes, or supports violent extremism or terrorism. This includes any User Content or conduct which is reasonably understood as endorsing or supporting extremist violence or the perpetrators of such acts; and promoting extremist ideologies or conspiracy theories that encourage or incite violence against others.
(11) General Prohibitions: Additionally, you agree not to: (a) reverse engineer, decompile, disassemble, decipher, or attempt to derive the source code of the Services or any underlying software; (b) interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services; (c) attempt to gain unauthorized access to the Services, user accounts, or computer systems or networks connected to the Services; (d) impersonate any person or entity or misrepresent your affiliation with any person or entity; (e) collect or store personal information about other users without their express permission.
You may have the ability to submit, post, or share content through our Services ("User Content"). By submitting User Content, you grant Extremesoft a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in any media now known or hereafter developed. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to your User Content and that it does not infringe upon or violate the rights of any third party.
All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the compilation thereof, are the exclusive property of Extremesoft or its licensors and are protected by Turkish and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You may not copy, modify, reproduce, distribute, republish, download, display, post, transmit, sell, lease, or create derivative works based on any part of the Services or its content without the prior express written consent of Extremesoft. Any use not expressly permitted by these TOS is a breach of these TOS and may violate copyright, trademark, and other laws.
Our Services may contain links to third-party websites, services, advertisements, or content that are not owned or controlled by Extremesoft. We have no control over and assume no responsibility for the content, privacy policies, terms of service, or practices of any third-party websites or services. You acknowledge and agree that Extremesoft shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such third-party content, goods, or services.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. EXTREMESOFT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED. EXTREMESOFT MAKES NO WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OBTAINED THROUGH THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EXTREMESOFT, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER EXTREMESOFT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
You agree to defend, indemnify, and hold harmless Extremesoft and its subsidiaries, affiliates, officers, directors, employees, agents, partners, contractors, licensors, and suppliers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your User Content; (c) your violation of these TOS; (d) your violation of any third-party right, including any intellectual property, property, or privacy right; or (e) any claim that your User Content caused damage to a third party.
Extremesoft reserves the right to suspend, disable, or terminate your access to the Services (or any part thereof), at any time, for any reason, including but not limited to violation of these TOS, without prior notice or liability to you. Upon termination, your right to use the Services will immediately cease, and you will forfeit any and all Virtual Goods, virtual currency, and other items associated with your account without compensation or refund of any kind. All provisions of these TOS which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These TOS and any dispute arising out of or related to these TOS or the Services shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these TOS or your use of the Services shall be brought exclusively in the courts located in Trabzon, Turkey, and you hereby consent to the personal jurisdiction and venue of such courts.
If any provision of these TOS is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these TOS, and these TOS shall be construed as if such invalid, illegal, or unenforceable provision had never been contained herein.
The failure of Extremesoft to enforce any right or provision of these TOS shall not constitute a waiver of such right or provision. Any waiver of any provision of these TOS will be effective only if in writing and signed by Extremesoft.
Extremesoft shall not be liable for any failure or delay in performing its obligations under these TOS where such failure or delay results from any cause beyond Extremesoft's reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
These TOS, together with our Privacy Policy and any other legal notices or policies published by Extremesoft on the Services, constitute the entire agreement between you and Extremesoft regarding the Services and supersede all prior and contemporaneous agreements, proposals, representations, and understandings, whether written or oral, relating to the subject matter hereof.
